1. Scope and Definitions

These Terms of Use govern the use of the app “Choreo Player”. They apply in addition to the Apple Standard EULA.

The provider named in the legal notice (hereinafter referred to as ‘we’ or ‘us’) is responsible for providing the app. The term “the app” refers solely to this mobile application.

2. Provision and Use of the App

The app is available for free on the Apple App Store and includes a basic version that allows users to explore the player’s features using integrated sample songs.

To add and play personal audio files, a one-time in-app purchase is required to unlock this functionality.

Payments are processed exclusively through the App Store. The terms and payment conditions specified there apply.

3. Use of Audio Content by the User

The app allows users to play their own audio content. The selection and use of this content – including uploading or providing it – is carried out solely by the user.

We have no influence over the type, origin, or legal admissibility of the audio files used by the user.

The user is solely responsible for holding all necessary rights and licenses for the content used within the app. This is particularly important for the public playback of music during events, presentations, or similar uses.

The use of copyrighted content without appropriate permission may lead to legal consequences. We accept no liability in this regard.

4. Use and Rights of Integrated Audio Content

The app contains selected audio content (e.g., sample songs, demos, or sound examples) for which the provider owns the corresponding copyright or usage rights.

This content may only be used within the app and for private, non-commercial purposes. Public performance, commercial use, reproduction, distribution, or modification of this content is strictly prohibited unless prior written permission is granted by the provider.

Extracting or separately storing this content outside the app is also not permitted.

5. Safety Notice and Liability for Improper Use

The app is not intended for use in safety-critical or potentially hazardous situations, especially not while participating in road traffic or during activities that require heightened attention.

Sudden volume changes, distraction, or intensive use may impair perception.

Use of the app is at your own risk. We are not liable for damages or accidents resulting from improper or inattentive use.

6. Third-Party Infrastructure

The App offers synchronization of user data via Apple iCloud and/or CloudKit as an optional additional feature. This functionality relies on third-party services and infrastructure over which the App provider has no control regarding technical availability, scope of functionality, pricing, or continued operation.

Third-party providers, in particular Apple, may modify, restrict, suspend, or discontinue such services or interfaces at any time for technical, legal, or commercial reasons.

Therefore, the App provider does not guarantee the permanent availability or unchanged usability of these features.

The discontinuation, restriction, or modification of such optional features shall not constitute grounds for any refund, damages, or reduction in payment, provided that the essential core functionality of the App remains substantially available as described.

Users are responsible for maintaining their own backups of important data where necessary.

This document is provided in German and English. If there are any differences, the German version applies.
